That means that Paypal can't charge the fee. __________________ Failure is NOT an option. It's mandatory.

Kassem | No it doesnt. It means that you can't charge someone because you decided to accept paypal. I am not going to argue of course, however other websites I go to do not allow it.
Also, if you are selling something, you are the merchant.

BernieB | That will depend on what state the merchant is in, California may not allow it, but Wisconsin does. |
WestWycke | Actually, it doesn't matter what state you are in. The PayPal Terms of Service (as quoted by Kassem) are quite specific. "You agree that you will not impose a surcharge or any other fee for accepting PayPal as payment."The statement about Visa, MC, and the laws of several states is only there to support why PayPal is imposing this condition on all of it's subscribers.

BoltBait | Remember, while it may be against the TOS to charge 4% extra for accepting PayPal... it is not againt the TOS to give a 4% discount for other payment methods, like cash or checks. Kassem | It was just an example. Either way :P just wondering, because usually MOTL is pretty strict on having members follow rules of other companies TOS, like Blizzard for example, even if it means just wording things differently in order to follow them. thanks |
Volcanon | Why should the seller eat fees? If a buyer wants convenience he should pay for it. If I agree to sell something for $10, then I want $10 for it, not $9.60. This is especially the case when Paypal gives an utterly unfair exchange rate should I try to exchange my USD to CND (and they refuse to allow me to simply send my USD to my Canadian USD account). |

But it doesn’t prevent sellers from making rules like this: "Shipping is $1 and handling is 4% of sale price, I will offer a 4% discount for paying with non-cc Paypal." Also if MOTL did make such a rule and block possible loopholes you would see a lot of sellers simply refusing to accept cc-Paypal. It appears that you want to pay with cc-Paypal and to stiff the sellers with the fees, but with or without a rule that isn’t going to happen. |
davef139 | VISA/MC terms state that and surcharge or minimum is against the TOS, the reasoning for PayPal to do it. It doesnt matter what state you live in its still aginst there TOS, the only loop around is a cash price. Some gas stations have this, another thing is if your ever in a dispute with someone and they add 4% for taking paypal and you mention that it will be an automatic loss for the seller. Also expressly saying you will offer a discount for non-cc PP would be liekly be seen as an effective surcharge loophole. |
